{"id":776,"date":"2015-07-03T21:36:10","date_gmt":"2015-07-03T21:36:10","guid":{"rendered":"https:\/\/mn-bankruptcy.com\/blog\/?p=776"},"modified":"2015-07-03T21:36:10","modified_gmt":"2015-07-03T21:36:10","slug":"why-everything-has-to-be-disclosed-when-filing-bankruptcy","status":"publish","type":"post","link":"https:\/\/mn-bankruptcy.com\/blog\/why-everything-has-to-be-disclosed-when-filing-bankruptcy\/","title":{"rendered":"Why Everything Has to be Disclosed when Filing Bankruptcy"},"content":{"rendered":"<p>I recently noticed a familiar name and face in an article in the Star Tribune. \u00a0The headline was <a title=\"Trustee Smells a Rat\" href=\"http:\/\/http:\/\/www.startribune.com\/minneapolis-bankruptcy-trustee-smelled-a-rat-and-got-the-goods-on-a-jewelry-store-owner\/309692071\/\" target=\"_blank\">&#8220;Minneapolis Bankruptcy Trustee Smelled a Rat and Got the Goods on Jewelry Store Owner,&#8221;<\/a> an article by reporter Randy Furst. \u00a0The article describes a situation \u00a0where a gentleman,\u00a0Daniel Rohricht, apparently closed his jewelry store, went out of business and filed Chapter 7 bankruptcy. \u00a0This was about four years ago. \u00a0The debts listed in the bankruptcy came to over $250,000.<\/p>\n<p>Mr. Rohricht claimed that all the jewelry was gone, having all been sold. \u00a0The bankruptcy seemed to go well. \u00a0One of our local bankruptcy trustees, a lawyer named Nauni Manty, was appointed as the trustee handling the case. \u00a0Ms. Manty knows a lot about jewelry and the jewelry business, but there was no evidence that anything was being hidden. \u00a0It is the trustee&#8217;s job to find assets for the creditors. \u00a0But after doing what investigation she could, she accepted a settlement of $17,500 from Mr. Rohricht. \u00a0The settlement agreement stated, however, that if Ms. Manty became aware of any undisclosed assets, the deal was off and they were back to square one.<\/p>\n<p>Years passed, but Ms. Manty did not forget Mr. Rohricht. \u00a0Eventually she got wind that he had purchased a store in Wisconsin and had gone back into business. \u00a0She was able to prove that the jewelry and precious stones that he was hauling into the new store were items he had hidden in 2009 prior to filing his bankruptcy. \u00a0To make a long story short, he recently pled guilty to concealing assets and is now facing federal prison and a very large fine.<\/p>\n<p>It&#8217;s not unusual that I will run into a person who has something he or she doesn&#8217;t want to disclose in their bankruptcy case. \u00a0They tend to believe firmly that it is something nobody would ever find out about. \u00a0That&#8217;s what Mr. Rohricht thought too. \u00a0I get asked why whatever it is must be disclosed. \u00a0Here&#8217;s why. \u00a0My understanding is that every year in Minnesota on average two or three people are convicted of bankruptcy fraud. \u00a0It&#8217;s never happened to any client of mine, and I really want to keep it that way.<\/p>\n<p>This post is for general information purposes only, is not legal advice and does not create an attorney-client relationship. \u00a0I am a debt relief agency, helping people file for relief under the federal bankruptcy code.<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>I recently noticed a familiar name and face in an article in the Star Tribune. \u00a0The headline was &#8220;Minneapolis Bankruptcy Trustee Smelled a Rat and Got the Goods on Jewelry Store Owner,&#8221; an article by reporter Randy Furst. \u00a0The article describes a situation \u00a0where a gentleman,\u00a0Daniel Rohricht, apparently closed his jewelry store, went out of &hellip; <\/p>\n<p class=\"link-more\"><a href=\"https:\/\/mn-bankruptcy.com\/blog\/why-everything-has-to-be-disclosed-when-filing-bankruptcy\/\" class=\"more-link\">Continue reading<span class=\"screen-reader-text\"> &#8220;Why Everything Has to be Disclosed when Filing Bankruptcy&#8221;<\/span><\/a><\/p>\n","protected":false},"author":2,"featured_media":751,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_monsterinsights_skip_tracking":false,"_monsterinsights_sitenote_active":false,"_monsterinsights_sitenote_note":"","_monsterinsights_sitenote_category":0,"footnotes":""},"categories":[206,12,28,107,1],"tags":[207,118],"class_list":["post-776","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-bankruptcy-fraud","category-chapter-7","category-filing-bankruptcy","category-filing-process","category-uncategorized","tag-bankruptcy-fraud","tag-how-does-bankruptcy-work"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v25.7 - You can see parts of Plymouth, Minnesota, Golden Valley, Minnesota and St. Louis Park, Minnesota from the high ground in front of my building. When asked about matters concerning credit scores, I like to say \"I'm a very good source of unreliable information about that.\" What I mean is that I hear a lot about it from my clients who often report back to me how they are doing after their bankruptcy is completed, sometimes even years later; but having heard some stories from a few people doesn't qualify me to give any advice. I spend a lot of time with my clients. I want to be sure we get it right. There are civil and criminal penalties for concealing or providing incorrect information in a bankruptcy care, and my goal is to keep myself and my clients as far away from problems like that as possible. You can see parts of Plymouth, Minnesota, Golden Valley, Minnesota and St. Louis Park, Minnesota from the high ground in front of my building.
