This is the fourth in a series and is about item four on my list \u2013 drawing down your 401K.   Items <a href=\"https:\/\/mn-bankruptcy.com\/blog\/things-to-avoid-before-bankruptcy-item-1-repaying-a-debt-to-a-close-friend-or-relative\/\">One<\/a>, <a href=\"https:\/\/mn-bankruptcy.com\/blog\/things-to-avoid-before-bankruptcy-item-2-transferring-assets-to-a-close-friend-or-relative\/\">Two<\/a> and <a href=\"https:\/\/mn-bankruptcy.com\/blog\/things-to-avoid-before-bankruptcy-item-3-large-payments-to-unsecured-creditors\/\">Three<\/a> on my list are discussed in previous blog posts.<br><br>In general, money in a 401K is safe from your creditors and safe from the bankruptcy trustee. This is ordinarily also true for IRA accounts as well.  Some exceptions have developed recently for accounts that are being transferred as part of a divorce and for accounts that have been inherited  &#8211; but these are fairly rare problems.  Usually a 401K or an IRA is the safest place your money can be.  I am very sad when right before coming to see me, somebody cleans out their retirement account. <\/p>\n\n\n\n<iframe loading=\"lazy\" width=\"560\" height=\"315\" src=\"https:\/\/www.youtube-nocookie.com\/embed\/BkhvWvMee8M\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture\" allowfullscreen=\"\"><\/iframe>\n\n\n\n<p>Most often I see they money used in an attempt to pay down debts.  It is almost never enough. Soon the money is gone, and because of finance charges and high interest rates, not much of a dent has been made in the debt load.  Other times people withdraw the money because they are afraid creditors will get it &#8211; which is sad because with the possible exception of the IRS or the child support people, creditors can&#8217;t touch it.  <br><br>As a general rule, if you are deeply in debt, you should talk with a lawyer before making any serious financial changes.<br><br>I am a debt relief agency. When asked about matters concerning credit scores, I like to say \\\"I'm a very good source of unreliable information about that.\\\" What I mean is that I hear a lot about it from my clients who often report back to me how they are doing after their bankruptcy is completed, sometimes even years later; but having heard some stories from a few people doesn't qualify me to give any advice. I spend a lot of time with my clients. I want to be sure we get it right. There are civil and criminal penalties for concealing or providing incorrect information in a bankruptcy care, and my goal is to keep myself and my clients as far away from problems like that as possible. You can find me in MInnetonka near I-394 and Hopkins crossroad. It's ten or fifteen minutes from downtown Minneapolis. You can see parts of Plymouth, Minnesota, Golden Valley, Minnesota and St. Louis Park, Minnesota from the high ground in front of my building. When asked about matters concerning credit scores, I like to say \"I'm a very good source of unreliable information about that.\" What I mean is that I hear a lot about it from my clients who often report back to me how they are doing after their bankruptcy is completed, sometimes even years later; but having heard some stories from a few people doesn't qualify me to give any advice. I spend a lot of time with my clients. I want to be sure we get it right. There are civil and criminal penalties for concealing or providing incorrect information in a bankruptcy care, and my goal is to keep myself and my clients as far away from problems like that as possible. You can see parts of Plymouth, Minnesota, Golden Valley, Minnesota and St. Louis Park, Minnesota from the high ground in front of my building.
