{"id":604,"date":"2013-10-01T18:16:46","date_gmt":"2013-10-01T18:16:46","guid":{"rendered":"https:\/\/mn-bankruptcy.com\/blog\/?p=604"},"modified":"2013-10-01T19:03:45","modified_gmt":"2013-10-01T19:03:45","slug":"bankruptcy-court-says-theyll-stay-open-for-ten-business-days","status":"publish","type":"post","link":"https:\/\/mn-bankruptcy.com\/blog\/bankruptcy-court-says-theyll-stay-open-for-ten-business-days\/","title":{"rendered":"Bankruptcy Court Says They&#8217;ll Stay Open for Ten Business Days"},"content":{"rendered":"<p>Late yesterday I received the following email from the clerk of bankruptcy court in Minneapolis:<\/p>\n<address>&#8220;In the event of a government shutdown on October 1, 2013, the United States Bankruptcy Court for the District of Minnesota will be open and will maintain normal hours and operations for approximately 10 business days. \u00a0All proceedings and deadlines remain in effect as scheduled and CM\/ECF will be available for the electronic filing and review of documents.&#8221;\u00a0\u00a0<\/address>\n<address>\u00a0<\/address>\n<p>This somewhat surprised me because last week I received the following email from the clerk of federal court&#8217;s office in Minneapolis:<\/p>\n<pre><em><span style=\"font-family: Georgia, 'Times New Roman', 'Bitstream Charter', Times, serif; font-size: 13px; line-height: 19px;\">\"JUDICIARY TO REMAIN OPEN IF GOVERNMENT SHUTS DOWN<\/span><\/em><\/pre>\n<p><em><span style=\"font-size: 13px; line-height: 19px;\">In the event there is a government shutdown beginning October 1, 2013, the United States District Court for the District of Minnesota will continue normal operations Tuesday, October 1, 2013. All cases, including civil and criminal jury trials, will be processed and argued and judgments will be issued and enforced according to usual schedules and priorities. The Clerk&#8217;s Office will be fully operational and CM\/ECF will continue to be fully functional.&#8221; \u00a0<\/span><\/em><span style=\"font-size: 13px; line-height: 19px;\">\u00a0(CM\/ECF means\u00a0Case Management\/Electronic Case Files.)<\/span><\/p>\n<p>I always thought of the bankruptcy court as being a branch of the federal judiciary, and the earlier of the two emails seemed to be saying that the federal judiciary would not be shut down at all. \u00a0 Guess I misunderstood that. \u00a0Apparently if the government shutdown continues for more than two weeks, we can expect the bankruptcy court to close.<\/p>\n<p>Either way the news for now is that the Minnesota bankruptcy court is open for business as usual. \u00a0Filings are being accepted and nothing is being postponed or rescheduled. \u00a0I expect that this is at least in part because there are very stiff filing fees in bankruptcy court. \u00a0Right now the filing fee for a Chapter 7 is $306 and \u00a0the filing fee for a Chapter 13 is $281. \u00a0Late last week I was charged $30 to file an amended document with the court. \u00a0I imagine that at any one time there are \u00a0enough of these fees in the pipeline to keep the place going for a while.<\/p>\n<p>Nevertheless, I invite all my clients to keep an eye out for emails and phone messages from me concerning possible delay or rescheduling of creditor meetings or other events. You can see parts of Plymouth, Minnesota, Golden Valley, Minnesota and St. Louis Park, Minnesota from the high ground in front of my building. When asked about matters concerning credit scores, I like to say \"I'm a very good source of unreliable information about that.\" What I mean is that I hear a lot about it from my clients who often report back to me how they are doing after their bankruptcy is completed, sometimes even years later; but having heard some stories from a few people doesn't qualify me to give any advice. I spend a lot of time with my clients. I want to be sure we get it right. There are civil and criminal penalties for concealing or providing incorrect information in a bankruptcy care, and my goal is to keep myself and my clients as far away from problems like that as possible.
